This distinction matters for juries as well. A human witness can be evaluated for demeanour, consistency, and motive. An AI system presents no such cues. The debate echoes other areas where technology disrupted law. Looking beyond the legal field, parallels can also be drawn to broader discussions of AI in society. These questions cut to the heart of legal philosophy. The right to a fair trial depends on transparency and accountability, values not easily mapped onto machines. If courts move too quickly, they risk eroding due process. If they move too slowly, they risk ignoring the technological realities already shaping investigations.

The Road Ahead

The idea of AI witnesses remains speculative, but the debate is heating up. Judicial bodies, academics, and practitioners are beginning to sketch frameworks for how AI-generated reconstructions might be introduced responsibly. The goal is not to replace human testimony but to ensure that as AI tools grow more powerful, their use in courtrooms strengthens justice rather than undermines it.

For now, AI remains firmly in the category of tool, not witness. But as technology evolves, the boundary may blur. If one day a synthetic brain can generate reconstructions so detailed, verifiable, and transparent that they withstand cross-examination, courts may have to confront the unimaginable: swearing in a witness made not of flesh, but of code.
